HOUSE CONCURRENT RESOLUTION NO. 65

Directing the joint committee on government and finance to make a study on special education in public schools.

Whereas, the amount of time that must spent on paperwork is exceedingly taxing on special education teachers; and

Whereas, the federal mandate requiring all students to take part in standardized testing may impact the work of special education teachers, therefore be it:

Resolved by the Legislature of West Virginia:

That the joint committee on government and finance is hereby directed to make a study on special education in public schools; and be it

Further Resolved, That the study should include, but is not limited to, consideration of the following issues:

(1) The impact of the considerable quantities of paperwork the teachers are responsible for that reduces the amount of time spent with the children;

(2) The implications of the federal mandate that requires all students to participate in standardized testing in school;

(3) The IEP process.

Further Resolved, That the said joint committee on government and finance shall conduct the study and prepare a report of its findings, conclusions and recommendations together with drafts of any legislation necessary to effectuate its recommendations; and be it

Further Resolved, That the joint committee on government and finance report to the regular session of the Legislature, 2002, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; and be it

Further Resolved, That the expenses necessary to conduct this study, to prepare a report and draft necessary legislation be paid from legislative appropriations to the joint committee on government and finance.
